Prepaid Service LABAS Terms of Service
Effective from 2024-12-03
UAB "Bitė Lietuva" (hereinafter referred to as "Bitė") provides public electronic communication services (hereinafter referred to as "services") to the "LABAS" user under the conditions and procedures specified in the "LABAS" Terms of Service set out below (hereinafter — the Rules):

Information about Services
Detailed information about all services available to LABAS users is provided on the LABAS website at www.labas.lt or by calling the LABAS customer service center.
Conclusion of Service Agreement
The service agreement between Bitė and the customer is considered concluded from the moment of activation of the SIM card (package) with LABAS service.
Provision effective from 2025-01-01:
The service agreement between "Bitė" and the LABAS user is considered concluded from the moment of activation of the SIM card (package) with LABAS service. The SIM card (package) with LABAS service is activated upon confirming the identity of the future LABAS user and registering the phone number. The LABAS user's identity can be verified remotely on the LABAS website, using the identification methods provided by LABAS, or by visiting one of the "Bitė" outlets. Future LABAS users under the age of 14 can confirm their identity and register the phone number by visiting any "Bitė" outlet together with their legal representative. In the event that the user has provided inaccurate and/or incorrect data, "Bitė" reserves the right not to provide LABAS services—immediately, without prior notice, to restrict or completely terminate the provision of LABAS services without refunding the price paid for the LABAS package and/or service.
Validity of Unactivated LABAS Cards
Purchased but unactivated LABAS cards have a limited validity period. The LABAS card must be activated within the period indicated on the package. If the card is not used within the specified time, "Bitė" reserves the right not to provide services. Money for such a package is not refunded.
Provision effective from 2025-01-01:
Purchased but unactivated LABAS cards have a limited validity period. The LABAS SIM card (package) must be activated (i.e., the identity of the future LABAS user must be confirmed and the phone number registered as specified in these LABAS Rules) within 90 days from the moment of inserting the SIM card into the device and receiving the SMS about activation procedures, but no later than the date indicated on the package. If the LABAS SIM card (package) is not activated within the specified time, "Bitė" reserves the right not to provide services. Money for such a package is not refunded.
Service Issues
If the service is not functioning, the user can contact the LABAS customer service center by phone or visit the nearest "Bitė" outlet, where, upon presenting the receipt proving the purchase of the card, the card will be replaced with a functioning one.
Service Charges
Services are provided and charged according to the prices and tariffs specified on the LABAS website, unless otherwise indicated on the purchased LABAS package.
Account Validity
The LABAS card account is valid for 3 months (90 days) from the moment of activation or from the last top-up of the LABAS card account with an amount not less than €3. While the account is active, all LABAS services can be used: make or receive calls, send or receive SMS, use mobile internet, etc. The LABAS user undertakes to use the services in accordance with the procedures specified in these Rules and/or the LABAS package. If the LABAS account is not topped up, after 3 months (90 days) it will be possible to call only free emergency numbers and only receive calls and SMS. If the LABAS account is not topped up for more than 4 months (120 days), a number maintenance fee of €0.12/day will be applied, which will be charged for 60 days until there is sufficient LABAS account balance and until the account is topped up with an amount not less than €3. If the account is not topped up and the account balance or 60-day period expires, the LABAS number will be blocked, become invalid, and will be canceled. An invalid LABAS number cannot be restored or reassigned to the LABAS user.
Provision effective from 2025-01-01:
The LABAS card account is valid for 3 months (90 days) from the moment of activation or from the last top-up of the LABAS card account with an amount not less than €3. While the account is active, all LABAS services can be used: make or receive calls, send or receive SMS, use mobile internet, etc. The LABAS user undertakes to use the services in accordance with the procedures specified in these Rules and/or the LABAS package. If the LABAS account is not topped up as specified above, after 3 months (90 days) it will be possible to call only free emergency numbers and only receive calls and SMS. If the LABAS account is not topped up as specified above for more than 4 months (120 days), the LABAS number will be blocked, become invalid, and will be canceled. An invalid LABAS number cannot be restored or reassigned to the LABAS user.
Maximum Validity Periods
Regardless of the frequency of top-ups, the account validity period cannot exceed 3 months (90 days) when topped up with an amount not less than €3, counting from the last account top-up. The number validity period cannot exceed 6 months (180 days) when the account is topped up with €3 or more, counting from the last account top-up.
Provision effective from 2025-01-01:
Regardless of the number and frequency of top-ups, the LABAS card account validity period cannot exceed 3 months (90 days), counting from the last top-up of the LABAS card account with an amount not less than €3. The LABAS number validity period cannot exceed 4 months (120 days), counting from the last account top-up with an amount not less than €3.
Service Quality
"Bitė" ensures that the quality of the provided services meets the requirements set for such services in the legal acts of the Republic of Lithuania. "Bitė" is not responsible for the quality of services if the LABAS user uses telephones that do not comply with the requirements set by legal acts of the Republic of Lithuania, do not technically support the services purchased by the LABAS user, or due to technical or other reasons (failures, etc.) that prevent the user from using the purchased LABAS services, as well as illegally acquired mobile phones or with a modified identification code. "Bitė" has the right to restrict the provision of services if the LABAS user uses telephones that do not comply with the requirements set by legal acts of the Republic of Lithuania, or if the LABAS user's mobile phone causes interference in "Bitė's" network.
Changes to Terms and Prices
"Bitė" has the right to unilaterally change the standard LABAS terms of service, prices for additionally ordered and standard services, and payment procedures if market conditions or market-regulating legal acts change, as well as on other objective grounds. About price and/or rate reductions, LABAS users will be informed in advance, and about changes in LABAS terms of service, increases in standard prices and/or rates, not later than 30 (thirty) days before the change date via SMS and/or by providing such information on the LABAS website www.labas.lt.
Disputes and Complaints
If the LABAS user believes that his rights have been violated, he can contact the LABAS customer service center by phone or in writing.
Fair Use Policy
The LABAS prepaid service is intended for personal use; therefore, all calls and SMS that are not aimed at communication between people are considered unfair. Unfair use is also considered the sending or receiving of an unreasonably large volume of SMS and calls that essentially does not correspond to the usual average consumption habits of our customers and is not similar to rational use of services for personal needs. "Bitė", upon noticing that the LABAS user is using the prepaid service improperly or violating the laws and other legal acts of the Republic of Lithuania, as well as receiving complaints from other customers about the actions of the LABAS user, reserves the right to restrict the provision of services to such a LABAS user and to demand compensation for incurred damages. Compensation for Service Interruptions
If due to "Bitė's" fault the user could not use LABAS services or they were charged incorrectly, "Bitė" undertakes to provide the user with services that he could not use, extend the service provision period, or, if it is not possible to do so or in the case of incorrect charging, compensate the corresponding amount by transferring it to the LABAS account. Information about services provided to the LABAS user and top-ups made by the user is stored for no longer than 6 months from the date of the event, so claims regarding provided services and payments made are accepted no later than 6 months after the last call, SMS, or service blocking.
User Responsibility
"Bitė" is not responsible for damages suffered by LABAS users if, not due to "Bitė's" fault, LABAS top-up security codes and top-up voucher numbers were disclosed or became known to third parties, or if third parties gained the opportunity to use the user's LABAS services. The user is responsible for the safety of his phone, top-up security codes, access data to the LABAS account, top-up voucher numbers, or other LABAS service information that provides the opportunity to use the LABAS service owned by the user, and for not disclosing it to third parties.
Lost or Damaged SIM Cards
If the LABAS card is lost or damaged, the card owner can purchase a duplicate at the nearest "Bitė" outlet. Ordered services or promotions, account balance, and all provided information are transferred to the new card. The card duplicate is issued according to the procedures established by "Bitė". An additional fee may be charged for issuing a duplicate.
Use of Account Balance
The amounts with which the LABAS user tops up the LABAS account or amounts credited to the LABAS user's LABAS account (e.g., compensations, mobile transfer top-ups received from LABAS and "Bitė" users, etc.), accumulated bonuses for calls received from other Lithuanian networks, and other bonuses received during LABAS or partner promotions, can be used only for LABAS services. These accumulated amounts are not exchangeable for cash. When the LABAS user stops using LABAS services, including cases when the LABAS user ports their number to another operator's network or changes the method of payment for services, the LABAS account balance is refunded to the LABAS user within 14 (fourteen) days from the date of submission of a properly completed and signed request to "Bitė". The LABAS user can submit the request by email to bendraukime@bite.lt or by visiting any "Bitė" outlet. You can find the request form here. When submitting the request by email, it must be signed with a qualified electronic signature.

The amounts with which the LABAS user tops up the LABAS account or amounts credited to the LABAS user's LABAS account (e.g., compensations, mobile transfer top-ups received from "Bitė" users, etc.), accumulated bonuses for calls received from other Lithuanian networks, and other bonuses received during LABAS or partner promotions, can be used only for LABAS services. These accumulated amounts are not exchangeable for cash. When the LABAS user stops using LABAS services, including cases when the LABAS user ports their number to another operator's network or changes the method of payment for services, the LABAS account balance is refunded to the LABAS user within 14 (fourteen) days from the date of submission of a properly completed and signed request to "Bitė". Annulling Bonuses
"Bitė" has the right to annul accumulated bonuses in cases where the LABAS user abuses their use for premium-rate services or other profiteering or commercial purposes. Bonuses can also be annulled if they were accumulated when the use of services is clearly not related to the personal needs of the customer to receive communication services and/or significantly differs from the average usage habits of "Bitė" prepaid LABAS service users.
Account Balance Limit
The user cannot have more than €1,000 in their account at one time; if the account balance is higher, account top-up may be restricted.
Notification of Changes to Rules
Information about changes to the Rules is provided to the LABAS user on the website www.labas.lt.
Service Availability Guarantee
LABAS guarantees smooth service provision at 95%. This means that LABAS services can be reliably used 95% of the time during the month. Technical maintenance is not included in the remaining percentage. All service disruptions in the "Bitė" network are eliminated within one working day from the moment a notification about the malfunction is received.
Processing of Personal Data
"Bitė" processes the personal data of LABAS users for the purpose of providing services. When providing services to LABAS users, "Bitė" may collect and process the following categories of personal data: (1) your basic data: LABAS phone number and/or other data necessary for the provision and/or administration of ordered services; (2) service usage data: information about ordered/used services, direct marketing preferences, LABAS account top-up data, etc.; (3) traffic and related data generated automatically when you use electronic communication means; (4) communication data regarding the use of LABAS services.

Direct Marketing
"Bitė" has a legitimate interest in conducting its own similar goods or services marketing, according to Article 69(2) of the Law on Electronic Communications of the Republic of Lithuania. Therefore, to your used LABAS phone number and/or provided email address, it may send you direct marketing messages related to the offered LABAS goods and/or services. Nevertheless, you can opt out of these messages by calling 1541; in the self-service at mano.labas.lt; or by following the "unsubscribe" instructions in the received SMS or email.
User Identification for Detailed Reports
If "Bitė" cannot identify the LABAS user, a detailed call report and other information related to personal data are not provided to the person. The LABAS user can perform identification by registering at www.labas.lt.
